3. WHAT PERSONAL INFORMATION WE COLLECT

We collect the following categories of personal information:

Client Information:

Name, surname, email address, phone number, wedding date, and venue details. This is provided by the Client when booking or enquiring.

Payment Information:

Billing details, payment method, and transaction history. This is processed via our payment gateway. We do not store full card details.

Guest Content:

Photos, videos, and any text uploaded by Guests to the Album.

Guest Metadata:

Time and date of upload, device type, and IP address (collected for security and analytics purposes).

Website Usage Data:

IP address, browser type, pages visited, referral source, and time spent on the site. This is collected via cookies and analytics tools.

Communication Data:

WhatsApp messages, emails, and any other correspondence with us.

4. HOW WE USE YOUR INFORMATION

We use your personal information only for the following purposes:

  • To provide the Service (e.g., generate QR Code, store Content, enable uploads) – Performance of a contract
  • To process payments and send invoices – Performance of a contract
  • To communicate with you about your booking (confirmation, reminders, updates) – Performance of a contract / Legitimate interest
  • To send you marketing communications (only with your explicit consent) – Consent
  • To moderate Content (either by us or by the Client's appointed moderator) – Performance of a contract / Legitimate interest
  • To improve our website, services, and user experience – Legitimate interest
  • To comply with legal obligations (e.g., POPIA, tax laws) – Legal obligation
  • To respond to complaints, queries, or data subject requests – Legal obligation / Legitimate interest

5. HOW WE STORE AND PROTECT YOUR INFORMATION

5.1 Storage Location:

All Content and personal information are stored on secure cloud servers provided by reputable third-party providers (e.g., AWS, Google Cloud). These servers may be located outside South Africa. By using our services, you consent to the transfer of your information to these jurisdictions.

5.2 Security Measures:

We implement reasonable technical and organisational measures to protect your personal information against unauthorised access, disclosure, or use; accidental loss, alteration, or destruction; and cyberattacks, malware, or hacking attempts.

These measures include:

  • Encryption of data in transit and at rest
  • Access controls and password protection
  • Regular security monitoring and updates
  • Secure payment processing via trusted payment gateways

5.3 Data Retention:

  • Client information is retained for as long as necessary to provide the Service and comply with legal obligations (e.g., tax records).
  • Guest Content is stored for 6 months from the wedding date, after which it is permanently deleted.
  • Marketing data is retained until you withdraw your consent.

5.4 No Guarantee:

While we take reasonable steps to protect your data, no method of transmission or storage is 100% secure. We cannot guarantee absolute security and are not liable for breaches caused by third parties, hacking, or other unlawful acts.

6. WHO WE SHARE YOUR INFORMATION WITH

We do not sell, rent, or trade your personal information to third parties.

We may share your information only in the following circumstances:

  • Payment Gateway: To process payments securely – necessary to complete the transaction.
  • Cloud Storage Provider: To store uploaded Content and Client data – necessary to provide the Service.
  • Our Moderators: To review and approve/reject Content (if you choose our moderation service) – performance of the Service.
  • Legal Authorities: If required by law or to protect our rights – legal obligation.
  • Your Appointed Moderator: If you choose to appoint your own moderator (we provide them with login credentials) – performance of the Service.

Third-Party Countries:

We may transfer your personal information to countries outside South Africa (e.g., where our cloud providers are based). We ensure that such transfers comply with POPIA requirements.

7. YOUR RIGHTS UNDER POPIA

You have the following rights regarding your personal information:

  • Right to Access: You may request a copy of the personal information we hold about you.
  • Right to Correction: You may request that we correct or update inaccurate or outdated information.
  • Right to Deletion: You may request that we delete your personal information (subject to legal retention obligations).
  • Right to Object: You may object to our processing of your information for marketing purposes.
  • Right to Withdraw Consent: You may withdraw your consent to marketing communications at any time.
  • Right to Lodge a Complaint: You may lodge a complaint with the South African Information Regulator if you believe your rights have been violated.

8. GUEST RIGHTS

8.1 Guests who upload Content to the Album have the same rights under POPIA as detailed in Section 7.

8.2 Guests may:

  • Request access to their uploaded Content
  • Request deletion of their uploaded Content
  • Request that their Content not be shared with third parties (subject to the Service requirements)

8.3 To make a request, Guests should contact our Information Officer directly.

8.4 The Client (the wedding couple) does not have the authority to delete a Guest's Content on behalf of the Guest, unless the Guest has specifically authorised them to do so.

9. COOKIES

9.1 Our website uses cookies to enhance your browsing experience and to analyse traffic.

12.1 In the event of a data breach that is likely to result in harm to you, we will:

  • Notify you as soon as reasonably possible
  • Notify the South African Information Regulator as required by POPIA
  • Take all reasonable steps to mitigate the breach

12.2 If you suspect a breach has occurred, please contact our Information Officer immediately.

13.1 We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal requirements.
