1. INTRODUCTION
1.1 These Terms and Conditions ("Terms") govern your use of the digital wedding solutions provided by The Wedding Studio, a division of Regi Health Pty Ltd (Registration Number: 2017/212980/07), a company registered in South Africa with its registered address at:
236 Vaandrager, Dorandia, Pretoria, 0182, South Africa
1.2 By booking our services, you ("the Client", "the Bride", "the Groom", "the Couple", or "the Parents") agree to be bound by these Terms.
1.3 These Terms apply to all services provided by The Wedding Studio, including but not limited to:
- Digital guest photo and video albums
- QR code generation and management
- Moderation services (where applicable)
- Any future digital wedding solutions offered by The Wedding Studio
1.4 The Wedding Studio reserves the right to update these Terms at any time. The latest version will always be available on our website at theweddingstudio.co.
2. DEFINITIONS

| "Moderation" | The process of reviewing and approving or rejecting Content before it is published in the Album |
| "Service" | The digital guest album solution provided by The Wedding Studio, including all associated features |
3. THE SERVICE
3.1 What We Provide:
- A private digital Album accessible via a unique link and QR Code
- Storage of uploaded Content for a period of 6 (six) months from the wedding date
- The ability for Guests to upload photos and videos from their mobile devices
- Live viewing of photos as they are uploaded (subject to moderation)
- A dashboard for the Client to view, manage, and download Content
3.2 How It Works:
- The Client receives a unique QR Code and Album link
- Guests scan the QR Code with their mobile device camera to access the Album
- Guests upload photos and videos directly from their phone – no app is required
- Content appears in the Album in real-time (subject to moderation where applicable)
3.3 Live Viewing:
- Guests can see each other's uploaded Content in real-time, creating a shared, interactive experience
- This feature is subject to internet connectivity and moderation settings
4. MODERATION OPTIONS
4.1 The Client has two options for Content moderation:
- Option 1: Client-Appointed Moderator (No Additional Fee)
- The Client appoints a person (e.g., friend, family member, bridesmaid) to moderate Content
- We provide login credentials to the appointed moderator
- The moderator reviews and approves/rejects Content in real-time during the wedding
- The Client takes full responsibility for the actions and decisions of their appointed moderator
- Option 2: Professional Moderation by The Wedding Studio (R549)
- We provide a professional moderator for the wedding day
- Moderation is active from 10:00 to 23:59 on the wedding day
- Our moderator reviews all Content and approves or rejects it based on our Moderator Guidelines
- Rejected Content: If Content is rejected, it is not made public in the Album. However, it is not deleted. It remains stored in the dashboard area, allowing the Client to review, approve, or permanently delete it at their discretion after the wedding.
- No Deletions: We do not delete any Content. Only the Client can permanently delete Content after the wedding.
- The Client is under no obligation to use our moderation service
4.2 Moderator Guidelines:
Our moderators apply the following principles:
Approved Content:
- Clear, well-lit photos
- Candid moments
- Group photos
- Short, engaging videos
- Content that tells the wedding story
Rejected Content:
Our moderators reserve the right to reject any Content that falls into the following categories:
- Blurry, out-of-focus, or poor-quality photos that do not meet a reasonable standard of clarity
- Duplicates or near-duplicates of the same image or moment, to avoid clutter and repetition in the Album
Inappropriate, offensive, or explicit Content, including but not limited to:
- Profanity, vulgar gestures, or sexually suggestive material
- Content that is discriminatory, racist, sexist, or otherwise hateful
- Content that depicts illegal activities or substance abuse
- Irrelevant Content that does not relate to the wedding, the couple, or the celebration (e.g., selfies unrelated to the event, random personal photos, screenshots, or unrelated memes)
- Excessively long or low-quality videos that lack engagement, are poorly lit, or do not capture meaningful moments
- Content that does not relate to the wedding or the couple's celebration
- Content that may be hurtful, embarrassing, or damaging to the Client, the couple, their families, or any Guest
- Content that could harm the Client's image, reputation, or personal brand, or that of their Guests, including photos that may be misconstrued, taken out of context, or depict moments that the Client would reasonably not wish to be shared publicly or permanently stored
- Content that infringes on the privacy or dignity of any person present at the wedding
- Content that violates any applicable law or third-party rights, including copyright, privacy, or publicity rights
- Note: Rejected Content is not made public in the Album. However, it is not deleted — it remains stored in the dashboard area for the Client to review, approve, or permanently delete at their discretion after the wedding. The Client retains full control over all Content.
4.3 Client Discretion:
- The Client retains full control over the Album
- The Client may review, approve, or reject any Content at any time
- The Client may permanently delete any Content from the Album at any time
5. STORAGE & DATA RETENTION
5.1 Storage Period:
- Content is stored for 6 (six) months from the wedding date
- After this period, all Content is permanently and irretrievably deleted from our servers
5.2 Storage Capacity:
- The Client's chosen package includes a specific storage limit (e.g., 10GB, 30GB, 50GB, etc.)
- If the storage limit is exceeded, the Client will be notified and offered the option to upgrade
5.3 Download Responsibility:
- The Client is solely responsible for downloading and saving all Content before the 6-month storage period expires
- We will send reasonable reminders, but we are not liable for any loss of Content due to the Client's failure to download within the storage period
- We do not delete Content during the storage period – only the Client can delete Content
5.4 Backups:
- We maintain reasonable backups to protect against data loss
- However, we are not liable for any loss of Content due to technical failures beyond our reasonable control
6. INTERNET & CONNECTIVITY
6.1 A working internet connection is essential for the Service.
6.2 Our Responsibility:
- The Wedding Studio does not provide or guarantee internet connectivity at the venue
- We do not provide Wi-Fi, mobile data, or any other connectivity solutions
6.3 Client Responsibility:
The Client is responsible for ensuring that Guests have access to internet connectivity at the venue
This may include:
- Venue-provided Wi-Fi
- Guests' own mobile data
- Any other connectivity arrangements made by the Client
6.4 Venue Wi-Fi:
- If the Client relies on venue Wi-Fi, the Client must confirm with the venue that Wi-Fi is available and can handle the expected number of users
- The Wedding Studio accepts no liability for Wi-Fi failures, slow connectivity, or network congestion at the venue
6.5 Guest Mobile Data:
- Guests can use their own mobile data to upload Content
- The Wedding Studio accepts no liability for any costs incurred by Guests for data usage
6.6 Upload Failures:
The Wedding Studio is not liable for upload failures caused by:
- Poor or no internet connectivity
- Venue Wi-Fi restrictions or firewalls
- Guest device compatibility issues
- Guest error or failure to follow instructions
6.7 Alternative Upload Option:
- Guests can upload Content at any time before or after the wedding using the same QR Code or Album link
- This allows Guests to upload even if they cannot connect on the wedding day
7. PRICING & PAYMENT
7.1 Pricing:
- All prices are quoted in South African Rand (ZAR)
- Prices are subject to change, but the Client will be quoted the applicable price at the time of booking
7.2 Once-Off Payment:
- All Services are provided on a once-off payment basis
- There are no monthly fees, subscription fees, or recurring charges
7.3 Payment Terms:
- Full payment is required before the Service is activated
- Payment must be made via the payment method selected at booking (e.g., credit card via our payment gateway, or other accepted methods)
7.4 Price Lock-In:
- The Client's quoted price is locked in at the time of booking
- Any promotional pricing (e.g., R399 special offer) is valid only for the specified period
7.5 Refund Policy:
Refunds are governed by our separate Refund Policy, which forms part of these Terms
In summary:
Full refunds may be offered if our system fails completely and is unusable on the wedding day
Refunds are not offered for:
- Poor internet connectivity at the venue
- Guests failing or refusing to upload Content
- Client or Guest technical errors
- Change of mind after the Service has been activated
- Any reason beyond our reasonable control
8. MODERATION FEE (Option 2)
8.1 If the Client selects our Professional Moderation service, an additional fee of R549 (five hundred and forty-nine Rand) is payable.
8.2 This fee is non-refundable unless The Wedding Studio fails to provide the moderation service as described in Clause 4.
8.3 The moderation service is active only on the wedding day from 10:00 to 23:59.
8.4 Content submitted outside of these hours will be moderated by the Client or their appointed moderator.
9. CLIENT RESPONSIBILITIES
9.1 The Client agrees to:
- Display the QR Code prominently at the wedding venue (e.g., on tables, at the entrance, near the bar)
- Inform Guests about the Service and how to use it
- Ensure that Guests understand that internet connectivity is required
- Ensure that Guests are aware that they may use their own mobile data to upload Content
- Where applicable, appoint a moderator and provide them with the necessary credentials
- Download all Content within the 6-month storage period
9.2 No Liability: The Wedding Studio is not liable for any failure caused by the Client's failure to meet these responsibilities.
10. GUEST CONTENT
10.1 Ownership:
- Guests retain full ownership of the Content they upload
- By uploading Content, Guests grant The Wedding Studio a non-exclusive, royalty-free license to store, display, and manage the Content within the Album for the duration of the Service
10.2 Guest Representations:
By uploading Content, Guests represent and warrant that:
- They own the Content or have the right to upload it
- The Content does not infringe any third-party rights (including copyright, privacy, or publicity rights)
- The Content is not illegal, offensive, defamatory, or inappropriate
10.3 Moderation:
- All Content is subject to moderation (either by the Client's appointed moderator or by The Wedding Studio, depending on the Client's choice)
- We reserve the right to reject Content that we deem inappropriate, irrelevant, or of poor quality
10.4 No Content Deletion by Us:
- The Wedding Studio does not delete Content
- Rejected Content remains stored in the dashboard area and is not made public
- The Client may review, approve, or permanently delete rejected Content at their discretion
10.5 Guest-Shared Content: The Wedding Studio provides the gallery platform as a service. The couple is responsible for communicating privacy guidelines to their guests. The Wedding Studio is not liable for any unauthorized sharing, distribution, or misuse of gallery content by guests, nor for any content uploaded by guests.
11. LIMITATION OF LIABILITY & DISCLAIMER
11.1 THE WEDDING STUDIO PROVIDES THE SERVICE "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
11.2 TO THE MAXIMUM EXTENT PERMITTED BY SOUTH AFRICAN LAW, THE WEDDING STUDIO DISCLAIMS ALL LIABILITY FOR:
- Service Failure: We are not liable if the Service, platform, app, website, or any part thereof fails, crashes, becomes unavailable, or does not perform as expected for any reason whatsoever.
- Technical Issues: We are not liable for any technical issues, bugs, errors, downtime, or malfunctions of our system, software, or infrastructure.
- Data Loss: We are not liable for any loss of Content, data, or memories, whether due to technical failure, human error, hacking, or any other cause.
- Internet Connectivity: We are not liable for poor or no internet connectivity at the venue, including venue Wi-Fi failures or guest mobile data issues.
- Guest Actions: We are not liable for the actions, omissions, or uploads of any Guest.
- Moderation Decisions: While we make reasonable efforts to moderate Content, we are not liable for any Content that is approved or rejected, including any emotional distress caused by moderation decisions.
- Third-Party Services: We are not liable for any failures of third-party services (e.g., payment gateways, cloud hosting providers).
- Indirect Damages: We are not liable for any indirect, consequential, special, or incidental damages, including but not limited to:
- Loss of memories or emotional distress
- Loss of opportunity or enjoyment
- Any financial loss beyond the amount paid for the Service
11.3 CAP ON LIABILITY:
- Our total liability to the Client, whether in contract, delict (tort), or otherwise, is strictly limited to the total amount paid by the Client for the Service.
- Under no circumstances will The Wedding Studio be liable for any amount exceeding the total amount paid by the Client.
11.4 CLIENT ACKNOWLEDGEMENT:
By booking the Service, the Client acknowledges and agrees that:
- The Service is a digital solution that depends on multiple factors, including internet connectivity, guest participation, and technical infrastructure.
- The Wedding Studio is a facilitator, not a guarantor, of the Album's success.
- The Client assumes all risk associated with the use of the Service.
- No refund, compensation, or damages will be payable if the Service fails, the app fails, or any technical issues arise.
11.5 FORCE MAJEURE:
- We are not liable for any failure to perform our obligations due to events beyond our reasonable control, including but not limited to:
- Natural disasters
- Acts of God
- War, terrorism, or civil unrest
- Power outages or internet outages
- Government or regulatory actions
12. INTELLECTUAL PROPERTY
12.1 The Wedding Studio owns all intellectual property rights in:
- Our brand, name, and logo (The Wedding Studio)
- Our website (theweddingstudio.co)
- Our system, platform, and software
- Our content, including taglines, marketing materials, and copy
12.2 The Client is granted a limited, non-exclusive license to use the QR Code and Album link for their personal wedding use only.
12.3 The Client may not:
- Copy, reproduce, or distribute our system or platform
- Use our brand or logo without permission
- Reverse engineer our software or technology
13. PRIVACY & DATA PROTECTION (POPIA)
13.1 The Wedding Studio is committed to protecting personal information in compliance with the South African Protection of Personal Information Act, 2013 (POPIA) .
13.2 Information Officer:
- The appointed Information Officer for The Wedding Studio is Vince Willett.

13.3 Data We Collect:
- From the Client: Name, contact details, wedding date, payment information
- From Guests: Uploaded photos and videos (which may contain personal information)
13.4 Purpose:
We collect and process this data solely for the purpose of providing the Service
13.5 Data Sharing:
We do not sell or share Client or Guest data with third parties, except:
- Where necessary to provide the Service (e.g., with our payment processor, cloud storage provider)
- Where required by law
13.6 Guest Rights:
- Guests may request access to their personal information (including their uploaded Content)
- Guests may request correction or deletion of their personal information
- These requests should be directed to our Information Officer
13.7 Data Security:
- We implement reasonable technical and organisational measures to protect data
- However, we are not liable for breaches caused by third parties, hacking, or other unlawful acts
13.8 Complaints:
If you believe your personal information has been mishandled, you may lodge a complaint with the South African Information Regulator at: https://www.justice.gov.za/inforeg/
14. DISPUTE RESOLUTION & JURISDICTION
14.1 Governing Law:
These Terms are governed by the laws of the Republic of South Africa
14.2 Dispute Resolution:
- In the event of a dispute, the parties shall first attempt to resolve the matter amicably through negotiation
- If the dispute cannot be resolved, it shall be referred to mediation or arbitration in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA)
14.3 Jurisdiction:
The parties submit to the exclusive jurisdiction of the courts of the Republic of South Africa
15. SEVERABILITY
15.1 If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be severed from the Terms, and the remaining provisions shall continue to be valid and enforceable.
16. ENTIRE AGREEMENT
16.1 These Terms constitute the entire agreement between the Client and The Wedding Studio.
16.2 They supersede all prior agreements, representations, or understandings, whether written or oral.
